These Terms of Use govern your use of our website, apps, and other products and services. As some of our Services may be software that is downloaded to your computer, phone, tablet, or other device, you agree that we may automatically update this software, and that these Terms will apply to such updates. Please read these Terms carefully, and contact us if you have any questions. By using our Services, you agree to be bound by these Terms, including the policies referenced in these Terms.

The following terms and conditions (the “Terms”) apply to our provision and your use of the information, services and materials (“Online Content and Courses”) through the Tugather website (the “Website”) and mobile applications (the “Apps”) including you visiting and browsing the content (being a “Visitor”) and registering with Tugather as a student (a “Learner”).

These Terms should be read alongside, and are in addition to our policies.

1. About Us

1.1      In these Terms, references to “we” or “us” are to Tugather LLC, a company incorporated in Kuwait.

1.2      In these Terms, references to “you” or “your” are references to you whether as a Learner or Visitor.

1.3      Tugather offers Online Content and Courses from professional and mature tutors and other people of expertise from across the world (“Partner Tutors”).

1.4      If you have any questions about these Terms or wish to contact us for any reason please click on “contact us”, which can be found on the Website.

2. Using the Website (Learner conduct)

2.1      By using our Website and Apps and the Online Content and Courses, you confirm that you have read, agree and are in compliance with these Terms and Policies (each as amended from time to time).

2.2      Your use of and access to this Website and Apps are subject to the following conditions (“Acceptable Use Conditions”), and you agree that failure to comply with any one of the Acceptable Use Conditions will constitute a breach of these Terms. The Acceptable Use Conditions are as follows:

  1. You agree to use the Website and Apps only for lawful purposes and your use of the Website and Online Content and Courses is in no way unlawful or fraudulent, and does not have the intention or effect of damaging us or our Tutor Partners either reputation ally or financially.
    1. You agree not to use or access the Website or the Online Content and Courses for the purpose of harming or attempting to harm any person in any way.
    1. You agree not to distribute all or any part of the Website or Apps online content and courses in any medium without our prior written consent, unless such distribution is offered through the functionality of the Website and permitted by these Terms.
    1. You agree not to access the Website or Apps or Online Content and Courses through any technology other than the software provided by us or enabled via API’s or other generally available third-party web browsers such as Chrome, FireFox, Safari or Internet Explorer.
    1. You agree not to (and will not attempt to) circumvent, disable or otherwise interfere with any security related features of the Website and Apps or any features that (i) prevent or restrict use or copying of content or (ii) enforce any limitations on you, the use of the Website and Apps or access to the Online Content and Courses.
    1. You agree not to knowingly transmit any data or send or submit any content that contains viruses, Trojan horses, worms, time-bombs, key-stroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
    1. You agree not to use or access the Website or Apps or Online Content and Courses for any commercial uses or for the benefit of any third party, including but not limited to:
      1.      the sale of access to the Online Content and Courses or any associated content.
      1.      the solicitation of business in the course of trade or in connection with a commercial enterprise.
      1.      the solicitation of any Visitors or Learners of the Website with respect to their content for commercial purposes.
    1. You agree to use the Website and access the Online Content and Courses in a way which does not infringe the rights of third parties or restrict or prevent anyone else’s use and enjoyment of the Website, Apps, or Online Content and Courses.
    1. You agree not to ask for, collect or harvest any personal data of any Visitor or Learner of the Website, Apps, or Online Content and Courses.
    1. You agree not to post, upload, email or otherwise transmit to or otherwise cause us to email, transmit or otherwise distribute chain letters, surveys or studies, calls to action, junk mail, pyramid schemes, incentives (monetary or click-based), spimming or spamming, or bulk communications of any kind, whether or not for commercial or non-commercial purposes.
    1. You will not copy, reproduce, create derivative works of, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content contained on the Website or Apps (including without limitation the Online Content and Courses) for any other purpose other than as permitted by these Terms without our prior written consent.
    1. You agree not to use the Website or the Online Content and Courses in any manner intended to damage, disable, overburden or impair any Tugather server or the network(s) connected to any Tugather server, or infringe any requirements, procedures, policies or regulations of any servers or networks connected to the platform.
    1. You agree not to use any high volume, automated, or electronic means to access the Website, Apps, or the Online Content and Courses (including without limitation robots, spiders or scripts).
    1. You agree not to frame the Website or the Online Content and Courses, place pop-up windows over its pages, or otherwise affect the display of its pages.
    1. You agree not to access or attempt to access any other Learner’s account or falsely state, impersonate, or otherwise misrepresent your identity, including but not limited misrepresenting your affiliations with a person or entity, past or present.
    1. You agree not to force headers or otherwise manipulate identifiers in order to disguise the origin of any communication transmitted through the Website.
    1. You agree not to send, knowingly receive, submit, download, use or re-use any material which does not comply with these Terms and Policies.

2.3      We grant the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. We reserve the right to revoke these exceptions, either generally or in specific cases.

2.4      You acknowledge and agree that the form and nature of the Website, Apps and Online Content and Courses which we provide may change from time to time without prior notice to you.

2.5      Whilst we do all we can to ensure that the Online Content and Courses are of a high standard, you understand and acknowledge that, in using the Website, Apps and Online Content and Courses, you may be exposed to content from our Partner Tutors that is factually inaccurate, offensive if taken out of context, indecent to certain people, or otherwise objectionable to you. We are not responsible (legally or otherwise) for any claims you may have against us in relation to this type of content.

2.6      You acknowledge and agree that we may stop (permanently or temporarily) providing the Website, Apps or Online Content and Courses (or any part of the Online Content and Courses) to you or to Learners generally for whatever reason, at our sole discretion, without prior notice to you.

2.7      You agree that you are solely responsible for (and that we have no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences of that breach (including, but not limited to, any loss or damage which we or any third party may suffer).

3. Registration and Accounts

3.1      Any Visitor can view the Website and the Apps, but in order to participate fully in all activities and take part in the Online Content and Courses, you must register for a personal account (a “Learner Account”) by providing an email address, username, and a password. You agree that you will never divulge or share access or your access information to your Learner Account with any third party for any reason.

3.2      In setting up your Learner Account, you may be prompted to enter additional information, including your college, major, and any other information that will help us to tailor the services to suit you.

3.3      By registering with Tugather for a Learner Account, you agree (in addition to the Acceptable Use Conditions above) that you will not let anyone else use your Learner Account.

3.4      If you are disqualified for any reason, we may prohibit your access or participation in the Online Content and Courses.

4. Copyright Policy

4.1      It is our policy that any content included on the Website, Apps, or within the Online Content and Courses that infringes, or is likely to infringe, the intellectual property rights of any third party will be removed from the Website as soon as possible after we are made aware of such infringement or potential infringement.

4.2      If you are the owner of intellectual property rights, or are authorized to act on behalf of an owner, or authorized to act under any exclusive right, you should report any alleged infringements of your intellectual property rights taking place on or through the Website by emailing a Copyright Infringement Notice to Support@Tugather.net, containing at a minimum the details outlined in section 4.4 below.

4.3      We will take whatever action, in our sole discretion, we deem appropriate, including the removal of the challenged content.

4.4      When you notify us in accordance with paragraph 4.2, your written Copyright Infringement Notice must contain the following:

  • statement telling us you believe that you have found content on the Website which you believe infringes your intellectual property rights;
  • which country your intellectual property rights apply to;
  • the title of the content concerned and the full URL for access to that content;
  • statement explaining how the content infringes your intellectual property rights;
  • your mailing address, telephone number and email address so that we can contact you;
  • a statement that the information contained in the notice is accurate and that you are the owner of the intellectual property rights or have an exclusive right in law to bring infringement proceedings in respect of its use;
  • your signature (an electronic signature is sufficient).

4.5      We will, acting in our sole discretion, terminate Learner Accounts and access to the Website, Apps, and Online Content and Courses if a Learner has been notified of infringing activity (regardless of whether the Learner has taken appropriate action as we may direct).

5. Your Liability to Us

5.1       You indemnify and keep us fully indemnified from and against all actions, claims, demands, costs, expenses, liabilities, loss, damages or other monetary relief brought, made or awarded against or incurred by us resulting (directly or indirectly) from:

  1. you submitting Learner Content to the Website or participating in the Online Content and Courses;
    1. your access to or use of the Website or Online Content and Courses;
    1. your breach of any of these Terms; and
    1. any negligent act or omission, deliberate default or breach of statutory duty on your part.

5.2       Each indemnity in this paragraph is separate and independent from the other obligations in these Terms. Each of these indemnities is to remain fully effective despite any indulgence granted from time to time and despite any judgment or order.

6. Our Liability to you

6.1       The Website and the Online Content and Courses are provided to you “as is” and we make no warranty or representation to you with respect to them.

6.2       We exclude all representations, warranties, conditions and terms express or implied by statute, common law or otherwise to the fullest extent permitted by law. We accept no liability for any special, indirect, incidental, consequential or economic loss, or any other losses, howsoever caused arising out of or in connection with these Terms. This includes (without limitation):

  1. any loss of profit (directly or indirectly);
    1. any loss of goodwill; and
    1. any loss of opportunity.

6.3       We provide the Online Content and Courses on the Website in good faith but give no warranty or representation that the Online Content and Courses are accurate, complete or up-to-date or that they will meet your requirements, nor that the Website does not infringe the rights of any third party. We accept no responsibility or liability for your use of Online Content and Courses on the Website and Apps and your use is entirely at your own risk. While we take reasonable precautions to prevent the existence of computer viruses and/or other malicious programs on the Website, we accept no liability for them.

6.4       Information transmitted via this Website will pass over public telecommunications networks. We make no representation or warranty that the operation of this Website will be timely, secure, uninterrupted or error-free and disclaim all liability in that respect to the greatest extent permitted by law.

6.5       We accept no responsibility for any loss or damage incurred by you as a result of:

  1. any reliance placed by you on the completeness, accuracy or existence of any information or advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Website or in relation to the Online Content and Courses;
    1. any changes which we may make to the Website or Online Content and Courses, or for any temporary interruptions in the provision of the Website or Online Content and Courses;
    1. the deletion of, corruption of, or failure to store, any Online Content and Courses and other communications data maintained or transmitted by or through your use of the Website;
    1. your failure to provide us with accurate account information; or
    1. your failure to keep your account details secure and confidential.

6.6      We reserve the right to suspend your use of the Website and/or access to the Online Content and Courses at any time for operational, regulatory, legal or other reasons.

6.7      We may terminate your Learner Account or access/use of the Website with immediate effect:

  1. if we reasonably believe you or any Learner you are connected with are in breach of any of these Terms;
    1. in order to prevent any fraudulent, unlawful or abusive activity; or
    1. if it is necessary to prevent or stop any harm or damage to us, other Learners of the Website or the general public

7. Governing Law

7.1      These Terms, your use and access to the Website, and all other policies issued by us whether referred to by us herein or not are governed by and construed in all respects in accordance with the laws of the State of Kuwait.

7.2      Any or all disputes arising between you and us (whether contractual or non-contractual) in connection with your access and use of the Website, including as to the validity of these Terms or policy issued by us, will be subject to the exclusive jurisdiction of the courts of the State of Kuwait. For any dispute between you and us, you agree that you will first attempt to resolve it with us informally. In the unlikely event that we are unable to resolve the dispute in this manner within 28 days of the dispute being notified in writing, we both agree to submit to the exclusive jurisdiction of the courts of the State of Kuwait to resolve any such dispute.

7.3      Notwithstanding paragraph 7.2, you agree that we are permitted to apply for injunctive remedies (or any other types of interim relief) in any jurisdiction at any time.

8. Changes to the Website and these Terms

8.1      We may update or amend these Terms (as well as our Policies or and other guidance we issue) from time to time to comply with law or to meet our changing business requirements. When we update our Terms or Policies, we will take appropriate measures to inform you, consistent with the significance of the changes we make. Any updates or amendments will be posted on the Website.

8.2      For any operational, regulatory, legal or other reason, we reserve the right to modify, suspend or discontinue all of the Online Content and Courses with or without notice to you and we will not be liable to you or any third party for any such modifications, suspension or termination. By continuing to use the Website, you agree to be bound by the terms of these updates and amendments.

1. من نحن

1.1     في القواعد والشروط أدناه، مصطلح “نحن” يرمز إلى شركة توقاذر لخدمات استشارات التعليم (ذ.م.م) مسجلة في دولة الكويت. 

1.2     في القواعد والشروط أدناه، مصطلح “أنت” يرمز إليك كزائر أو طالب مسجل لدى المنصة.

1.3     توفر منصة توقاذر محتوى الكتروني وشروحات مقدمة من قبل معلمين مختصين أو ذو خبرة واطلاع في في مجالاتهم ومن جميع أنحاء العالم. 

1.4     في حال كان لديك أي استفسار عن تلك القواعد أو ربغتك بالتواصل معنا لأي سبب، يرجى الضغط على الرابط “تواصل معنا” والمتواجد في صفحات موقعنا. 

2. استخدام المنصة (قواعد سلوك المتعلم)

2.1     من خلال استخدامك لموقعنا وبرامج الهواتف الذكية والمحتوى والمحاضرات الالكترونية، فإنك تقر على اطلاعك وموافقتك واستيفائك لجميع القواعد واللوائح المطبقة (بجميع تحديثاتها).

2.2     ان استخدامك ودخولك للموقع والبرامج الذكية يخضع إلى (قواعد الاستخدام المقبولة)، وأن الفشل في تطبيق قواعد السلوك المقبولة يعد خرقا لشروط وقواعد استخدام خدمات المنصة، وفيما يلي قواعد الاستخدام المقبولة للمنصة:

1. يتم استخدام موقع وبرامج المنصة بما لا يخالف القانون وأن استخدامك لخدمات المنصة لا ينتج عنه أي عملية غير قانونية أو أي عمليات احتيال بجميع أشكالها، ويكون الاستخدام دون الاضرار بالمنصة أو بشركائنا من المعلمين في المنصة سواء ماليا أو فيما يضر بسمعتهم.

2. توافق على عدم استخدامك للموقع والبرامج أو المحتوى الالكتروني الخاص بالمنصة لالحاق أي أذى بأي شكل من الأشكال بأي شخص.

3. توافق على عدم الدخول على محتوى الموقع أو استخدامه الا من خلال موقعنا الالكتروني أو البرامج الذكية التي نوفرها بشكل رسمي وعدم الحصول على محتوى الموقع من خلال أي من المصادر الغير رسمية.

4. توافق على عدم نشر جزء أو كل محتوى الموقع والبرامج الذكية والشروحات بأي وسيلة من وسائل النشر دون الحصول على إذن خطي مسبق من قبلنا، وبما لا يخالف قواعد الاستخدام لدينا.

5. توافق على أنك لن تقوم أو تحاول القيام بأي خرق أو تعطيل أو تدخل لأنظمة الحماية لدى الموقع والبراممج الذكية والتي من شأنها (أ) استخدام أو نسخ للمحتوى المعروض (ب) تضع أي قيود لاستخدامك للموقع والبرامج الذكية.

6. توافق على عدم نقل أو ارسال أي محتوى يحتوي على فايروسات، أو برامج اختراق أو تعطيل بأي شكل من الأشكال والتي قد تعمل على تعطيل أعمال المنصة والاضرار بها.

7. توافق على عدم الدخول إلى الموقع والبرامج الذكية والمحتوى لدى المنصة من أجل أي غرض تجاري لمصلحة أي طرف ثالث، بما يشمل دون الحصر على:

أ. بيع المحتوى أو مفاتيح الدخول للمحتوى بجميع أشكالها.

ب. التواصل مع المعلمين وشركاء المنصة بهدف التعاملات التجارية.

ج. التواصل مع الطلاب ومستخدمي المنصة بهدف التعاملات التجارية.

8. توافق على استخدام المنصة والدخول على المحتوى الالكتروني بما لا يتعدى على حقوق أي طرف ثالث أو يعرقل أو يمنع أي شخص من الاستفادة من الدخول إلى المنصة والحصول على خدماتها.

9. تقر بعدم طلبك أي معلومات شخصية من زوار ومستخدمي المنصة ومحتواها الالكتروني.

10. تقر بعدم نسخ أو إعادة انتاج أو العمل على نشر، نقل، عرض، بيع، ترخيص استخدام أي من محتوى الموقع والبرامج الذكية بما يشمل المحتويات والمواد التعليمية بما يخالف قواعد استخدام المنصة ودون الحصول على اذن خطي مسبق من قبلنا.

11. تقر بعدم استخدام المنصة بجميع محتوياتها الالكترونية في ما يعمل على الاضرار أو تعطيل أو زيادة الحمل على سيرفرات المنصة أو الشبكات التي تعمل من خلالها، وكذلك عدم خرق أي متطلب أو إجراء أو لائحة لتلك السيرفرات.

12. تقر بعدم استخدام برامج التحميل العالي في استخدام المنصة ومتحواها.

13. تقر بعد الدخول أو محاولة الدخول لأحد حسابات المتعلمين عن طريق التزوير أو السرقة أو انتحال الشخصية بما يشمل تزوير علاقتك مع الشخص المسؤول عن الحساب.

14. تقر بعدم ارسال أو تحميل أو إعادة استخدام أي محتوى مخالف لقواعد استخدام المنصة.

2.3     تسمح المنصة لمحركات البحث المختلفة بالحصول ونسخ بعض من محتوى الموقع والمتوفر للاستخدام العام لغرض توفير مزايا البحث وسهولة الدخول للموقع والمحتوى، ويحق للمنصة وقف أو منع أي محنوى من مزايا الظهور في محركات البحث.

2.4     أنت على علم كامل ودراية بأن محتوى وشكل الموقع والبرامج الذكية والمحتوي التعليمي والالكتروني قد يتغيروا من وقت إلى آخر في سبيل التطوير ودون الحصول على أذن من المستخدم. 

2.5     على الرغم من أننا نسعى دائما على أن يكون المحتوى التعليمي بأفضل مستوى، ولكنك على علم ودراية بأنك ومن خلال تصفحك للموقع أو البرامج الذكية أو المحتويات التعليمية قد تتعرض لمعلومات خاطئة أو غير دقيقة أو يراها البعض مهينة بشكل ما من قبل معلمينا في المنصة، ونؤكد أننا غير مسؤولين بشكل قانوني أو بأي شكل من الأشكال عن المحتوى المعروض. 

2.6     أنت على علم كامل ودراية بأحقيتنا بوقف تقديم خدماتنا لك أو لأي مستخدم في المنصة، بشكل نهائي أو مؤقت، لأي سبب كان من تقديرنا الشخصي دون اخطار مسبق. 

2.7     أنت على علم كامل ودراية بأنك شخصياً مسؤول بشكل كامل عن عدم التزامك لهذه القواعد (وبما يشمل عدم وجود أي التزامات من قبلنا لك أو لأي طرف ثالث) وما ينتج عنه بما يشمل دون الحصر أي أضرار تتحقق لنا أو لطرف ثالث. 

3. التسجيل والحسابات

3.1     يحق لأي الزائر الاطلاع على الموقع والبرامج الذكية، ولكن في حال الرغبة في المشاركة في المنصة والاشتراك في المحتويات الالكترونية والتعليمية يتوجب عليه تسجيل حساب خاص (حساب طالب) من خلال تزويدنا بالبريد الاالكتروني، اسم المستخدم، وكلمة السر. وكذلك تقر بعدم مشاركة معلومات الدخول على الحساب الشخصي (حساب الطالب) مع أي طرف ثالث لأي سبب كان.

3.2     خلال تسجيلك لحساب طالب جديد، يمكنك تقديم بعض المعلومات الاضافية من ضمنها (الجامعة) و (التخصص) حيث تساعدنا هذه المعلومات في تقديم خدمة أفضل.

3.3     من خلال تسجيلك لحساب طالب جديد، فإنك وبالإضافة إلى قواعد الاستخدام المقبولة والمذكورة أعلاه، توافق على عدم السماح لأي شخص باستخدام حساب الطالب الخاص بك. 

3.4     في حال تم الغاء أو وقف حسابك لأي سبب كان، فقد يتم منع دخولك واطلاعك لأي محتوى تعليمي تم الاشتراك به. 

  4. حقوق الملكية الفكرية

4.1     يجدر التنويه أنه من ضمن سياساتنا أن أي محتوى في الموقع أو البرامج الذكية أو في الدروس والمحتويات التعليمية في حال تعارضه مع حقوق الملكية الفكرية لأي طرف ثالث، سيتم استبعاده بأقصى سرعة ممكنة بعد درايتنا أو اخطارنا بوجود هذا التعارض.

4.2     اذا كنت صاحب حقوق الملكية الفكرية، أو شخص مخول للتصرف بالنيابة عنه، يتوجب عليك تبليغنا بوجود هذا الخرق لحقوق الملكية الفكرية من خلال ارسال بريد الكتروني (اخطار خرق حقوق الملكية الفكرية) إلى البريد Support@tugather.net يحتوي على الأقل المعلومات المذكورة في الفقرة 4.4 في اللاحق.

4.3     سنتخذ الاجراء المناسب في حال الإبلاغ وذلك وفق تقديرنا الشخصي وبما يشمل حذف المحتوى. 

4.4     في حال تم ابلاغنا وفق الاجاراء المذكور في الفقرة 4.2، فإنه يتعين تزويدنا بالمعلومات التالية:

  • بيان يتم ذكر فيه بأنك وجدت محتوى في المنصة تعتقد بأنه يتعارض مع حقوق الملكية الفكرية؛
  • في أي دولة تم تسجيل حقوق الملكية الفكرية الخاصة بك؛
  • عنوان المحتوى المخالف للملكية الفكرية والرابط الالكتروني لذلك المحتوى؛
  • بيان يتم التوضيح في ما هي أوجه خرق الملكية الفكرية؛
  • تزويدنا بعنوانك ورقم هاتفك وبريدك الالكتروني لكي نستطيع التواصل معك؛
  • بيان بأن جميع المعلومات التي تم تزويدنا بها بالإخطار صحيحة وبأنك صاحب حقوق الملكية الفكرية أو تملك الحق القانوني بالتصرف بالنيابة عنه؛
  • التوقيع (أو التوقيع الالكتروني).

  5. مسؤولياتك تجاهنا

5.1     تتحمل مسؤولية تعويضنا بشكل كامل عن أي أضرار أو تكاليف أو مطالبات أو أي مسائل مالية تكون ناتجة بشكل مباشر أو غير مباشر من:

1. اراسلك أو مشاركتك بأي محتوى تعليمي في الموقع أو برامج الهواتف الذكية.

2. دخولك أو استخدامك لخدمات ومحتوى الموقع وبرامج الهواتف الذكية.

3. عدم التزامك بقواعد وسياسات استخدام المنصة.

4. أي اهمال أو عمل ينتج عنه عدم التزام أو خرق لقوانين الدولة.

5.2     جميع هذه التعويضات المذكورة مستقلة ومنفصلة عن أي التزامات أخري في هذه الشروط والأحكام كل على حدا، وتظل جميع هذه التعويضات سارية المفعول بخلاف أي تعويضات سابقة في وقت سابق وبخلاف أي أحكام سابقة صادرة بهذا الشأن.

   6. مسؤولياتنا تجاهك

6.1     يتم توفير الموقع والبرامج الذكية بكافة المحتوى التعليمي والالكتروني كما هم معروضين، دون وجود أي ضمانات أو وعود فيما يخص محتواهم أو طريقة عرضهم.

6.2     لا نتحمل مسؤولية التعويض عن ضرر أو خسارة مادية أو غير مادية تحققت بشكل مباشر أو غير مباشر ناتجة عن هذه القواعد والسياسات بما يشمل ودون الحصر:

1. أي خسارة لأرباح بشكل مباشر أو غير مباشر.

2. أي خسارة معنوية.

3. أي ضياع للفرص.

6.3     نوفر جميع المحتوى التعليمي والشروحات بنية حسنة دون أي ضمان على أن تكون تلك المعلومات دقيقة أو كاملة أو محدثة أو ترضي طموحك المرجو منها، ولا نضمن تعارضها مع حقوق الملكية الفكرية لأي طرف ثالث، ولا نتحمل أي مسؤووليات أو مطالبات متعلقة بأضرار ناتجة عن استخدامك لتلك المعلومات بحيث تتحمل أنت مسؤولية الاستخدام كاملة. كما سنعمل قدر المستطاع على منع وجود أي فيروسات أو برامج ضارة بالمنصة ولا نتحمل أي ضرر ناتج عنها.

6.4     يتم نقل البيانات والمعلومات الخاصة بالمنصة عن طريق شبكات الاتصال بالانترنت، ولا نؤكد أو نضمن أن تلك العمليات ستنقل بالوقت وبصورة آمنة دون خلل أو تقطيع، ونخلي مسؤوليتنا عن ذلك مع السعي نحو تقديم خدمة متميزة.

6.5     لا نتحمل مسؤولية أي ضرر أو خسارة تتحقق لك نتيجة الآتي:

1. أي تغيير أو تحديث نقوم به لمحتوى المنصة، أو أي تقطيع لحظي في نقل وعرض بيانات ومحتوى المنصة.

2. حذف أو تعطل أو فشل في تخزين أي محتوى أو معلومات ناتجة عن استخدامك للموقع أو برامج الهواتف الذكية.

3. فشلك في توفير معلومات صحيحة عن حسابك.

4. فشلك في ابقاء معلومات حسابك آمنة وسرية.

6.6     نحتفظ بكامل الحق بوقف استخدامك أو دخولك للموقع وبرامج الهواتف الذكية والمحتويات التعليمية في أي وقت لأسباب فنية أو إجرائية أو قانونية أو أي سبب يستدعي ذلك.

6.7     نحتفظ بكامل الحق بحذف حسابك ومنع استخدامك لخدمات ومتحويات المنصة في الحالات التالية:

1. لدينا ما يثبت إلا حد ما بقيامك شخصياً أو أي شخص له صلة بك بخرق ومخالفة قواعد استخدام المنصة.

2. لمنع أي أعمال غش أو مخالفة للقانون أو أي أعمال سلوكية مسيئة.

3. لمنع أي ضرر قد يتحقق لنا، أو لأي من مستخدمي أو زوار المنصة.

   7. القانون المنظم

7.1     إن هذه القواعد والسياسات التي تنظم استخدامك للمنصة وجميع القواعد والسياسات التي تصدر من قبل منصة توقاذر التعليمية تخضع لقانون دولة الكويت.

7.2     أي دعاوي قضائية قد تنشئ بيننا وبينك، سواء كانت تعاقدية أو غير تعاقدية، وخاصة باستخدامك للمنصة وخدماتها، وبما يشمل صلاحية هذه القواعد والسياسات الموضوعة من قبلنا، تكون خاضعة للنظام القضائي الكويتي. وفي حال وجود أي خلاف، تتعهد بأن تسعى إلى حله معنا بشكل غير رسمي قبل اللجوء إلى القضاء.

7.3     فيما يتعلق بالفقرة 7.2، فإنك توافق على مطالبتنا بأي تعويضات نتيجة التكاليف الناتجة عن الدعاوي القضائية المرفوعة. 

    8. التحديثات في المنصة وفي هذه القواعد والسياسات

8.1     قد نقوم يتحديث أو تغيير هذه القواعد والسياسات من وقت إلى آخر وذلك لمواكبة أي تغييرات قوانين الدولة أو أي تغييرات في نشاطاتنا التجارية، بحيث سيتم تحديث نص هذه القواعد في موقعنا الالكتروني.

8.2     يحق لنا ولأي أسباب تشغيلية أو إجرائية أو قانونية أو أي سبب آخر تغيير أو تعديل أو حذف جزء أو كل محتويات المنصة في الموقع وبرامج الهواتف الذكية والمحتويات التعليمية من دون أخطار مسبق دون تحمنا لأي مسؤولية لأي طرف ثالث.
